Welcome to Offquest. These Terms of Service ("Terms") govern your access to and use of the Offquest mobile application and related services (collectively, the "Service"), operated by Offquest ("Company," "we," "us," or "our").

BY DOWNLOADING, INSTALLING, OR USING OFFQUEST, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

1. Eligibility

You must be at least 13 years of age to use Offquest. If you are between the ages of 13 and 17, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to require proof of parental consent at any time.

Users under 18 are strongly encouraged to consult with a parent or guardian before participating in any real-world activities suggested by the Service. Parents and guardians assume responsibility for monitoring their minor's use of the Service.

You are responsible for ensuring that your use of the Service complies with all applicable local, state, national, and international laws and regulations.

2. Description of Service

Offquest is a gamified mobile application that provides challenges, quests, prompts, suggestions, and AI-generated feedback designed solely for entertainment, motivation, and personal development purposes (collectively, "Content").

The Content is generated through a combination of pre-written prompts and artificial intelligence. Content is not reviewed, verified, or approved by medical professionals, licensed counselors, certified fitness trainers, or any other qualified professional before being presented to you.

Offquest does not guarantee any specific results, outcomes, health improvements, fitness gains, or personal development milestones. Individual results will vary, and many factors outside our control affect outcomes.

3. Nature of Quests and Activities

Offquest suggests real-world activities that users may choose to undertake at their sole discretion. These activities may include, but are not limited to:

• Physical activities such as walking, running, hiking, exercise, cold exposure, and outdoor exploration
• Social interactions such as talking to strangers, public speaking, attending events, and initiating conversations
• Activities involving travel, navigation, and visiting unfamiliar locations
• Activities designed to push personal comfort zones, including confronting fears and taking social risks
• Mental challenges, creative tasks, and mindfulness exercises

ALL QUESTS AND ACTIVITIES ARE SUGGESTIONS ONLY. They are not instructions, prescriptions, directives, or professional recommendations. You are never required to complete any quest, and you should always exercise your own independent judgment about whether an activity is safe, appropriate, and legal for you given your individual circumstances, health, physical condition, location, weather, time of day, and any other relevant factors.

4. Assumption of Risk and Waiver

BY USING OFFQUEST, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

• Participation in any activity suggested by Offquest is entirely voluntary and at your own risk.
• Real-world activities carry inherent risks that cannot be eliminated, including but not limited to: physical injury, illness, death, emotional or psychological distress, property damage or loss, encounters with wildlife or hazardous conditions, interactions with unknown individuals, traffic accidents, falls, overexertion, heat stroke, hypothermia, dehydration, allergic reactions, and any other harm.
• You voluntarily assume full responsibility for any and all risks of injury, illness, damage, or loss arising from your participation in any activity, whether or not suggested by the Service.
• You have had the opportunity to consult with a physician or other medical professional before engaging in physical activities, and you understand the physical demands and risks involved.
• You waive, release, and forever discharge Offquest, its officers, directors, employees, agents, affiliates, successors, and assigns from any and all claims, demands, causes of action, damages, losses, and liabilities of every kind and nature, whether known or unknown, arising out of or related to your use of the Service or participation in any suggested activity.

This waiver and release applies to claims arising from the negligence of Offquest but does not apply to claims arising from gross negligence or willful misconduct, to the extent prohibited by applicable law.

5. Health and Safety Disclaimer

OFFQUEST IS NOT A MEDICAL, FITNESS, MENTAL HEALTH, OR THERAPEUTIC SERVICE.

The Service does not provide and should not be considered a substitute for:

• Medical advice, diagnosis, or treatment
• Licensed psychological or psychiatric counseling
• Certified personal training or fitness instruction
• Physical therapy or rehabilitation guidance
• Nutritional counseling or dietary advice
• Emergency services or crisis intervention

You should consult with qualified healthcare professionals before engaging in any new physical activity, especially if you have any pre-existing medical conditions, injuries, disabilities, or health concerns. If you experience chest pain, dizziness, shortness of breath, or any other symptoms during physical activity, stop immediately and seek medical attention.

Always listen to your body. If a quest feels unsafe or beyond your current ability, skip it. Your health and safety always come first.

If you are experiencing a mental health crisis, suicidal thoughts, or emotional distress, please contact the 988 Suicide and Crisis Lifeline (call or text 988) or your local emergency services. Offquest is not equipped to handle emergencies.

DO NOT PARTICIPATE IN ANY ACTIVITY IF YOU FEEL UNWELL, UNSAFE, PHYSICALLY INCAPABLE, OR UNSURE OF YOUR ABILITY TO COMPLETE IT SAFELY.

6. AI-Generated Content Disclaimer

Offquest uses artificial intelligence ("AI") to generate personalized quest suggestions, motivational messages, and coaching responses through a feature known as "Coach."

You acknowledge and agree that:

• AI-generated content may be inaccurate, incomplete, inappropriate, or unsuitable for your specific circumstances
• AI-generated suggestions do not constitute professional advice of any kind
• The AI does not know your medical history, physical limitations, local laws, environmental conditions, or personal circumstances
• You are solely responsible for evaluating whether any AI-generated suggestion is safe, legal, and appropriate for you
• Offquest is not liable for any harm resulting from your reliance on AI-generated content

The AI coach feature is for entertainment and motivational purposes only and does not create any professional, fiduciary, or advisory relationship.

7. No Professional Relationship

Use of Offquest does not create any professional relationship between you and the Company or any of its employees, contractors, or agents, including but not limited to a doctor-patient, therapist-client, trainer-client, coach-client, or advisor-advisee relationship.

8. User Responsibility and Conduct

You are solely responsible for your actions, decisions, and safety while using the Service. You agree that:

• You will use your own judgment, common sense, and awareness of your surroundings at all times
• You will assess risks before attempting any activity and decline any quest you deem unsafe
• You will obey all applicable laws, regulations, and rules, including traffic laws, trespassing laws, and local ordinances
• You will not engage in any activity that is unsafe, illegal, or harmful to yourself or others
• You will consider your personal health, fitness level, medical conditions, physical environment, weather, time of day, and all other relevant circumstances before participating in any activity
• You will not use the Service while operating a motor vehicle, heavy machinery, or engaging in any activity requiring your full attention
• You will not harass, threaten, stalk, or harm any individual in connection with completing a quest
• You will not trespass on private property or restricted areas
• You will not provide false or misleading information to the Service
• You will not attempt to misuse, reverse engineer, or exploit the Service

9. Nighttime and Solo Activity Warning

Some quests may suggest activities that involve being outdoors, exploring unfamiliar areas, or engaging with the world alone or at various times of day. You acknowledge that:

• You are solely responsible for assessing the safety of your environment, including time of day, lighting, neighborhood safety, and weather conditions
• Offquest does not assess, monitor, or guarantee the safety of any location, route, or environment
• You should never go to an unfamiliar or isolated location alone if you feel unsafe
• You should always inform someone of your whereabouts when engaging in outdoor or solo activities
• Offquest bears no responsibility for harm that occurs during any activity, regardless of the time, location, or circumstances

10. Third-Party Interactions

Some quests may encourage social interactions with other people. Offquest does not screen, vet, or control any individuals you may encounter. You acknowledge that:

• Any interactions with third parties are at your own risk
• Offquest is not responsible for the actions, behavior, or conduct of any third party
• You should exercise caution and good judgment in all social interactions
• You should never share personal information, follow strangers to isolated locations, or put yourself in vulnerable situations

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OFFQUEST, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:

• Direct, indirect, incidental, special, consequential, exemplary, or punitive damages
• Personal injury, bodily harm, or death
• Emotional distress, psychological harm, or mental anguish
• Property damage or financial loss
• Loss of data, revenue, profits, or business opportunities

ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF THE SERVICE, YOUR PARTICIPATION IN ANY QUEST OR ACTIVITY, OR YOUR INTERACTIONS WITH ANY THIRD PARTY, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF OFFQUEST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO OFFQUEST IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Offquest and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of or access to the Service
• Your violation of these Terms
• Your participation in any activities suggested by the Service
• Your violation of any applicable law or the rights of any third party
• Any content you submit, post, or transmit through the Service
• Any harm caused to any third party as a result of your actions taken in connection with the Service

13. Account and Username

You are responsible for maintaining the confidentiality of your account credentials. You agree not to impersonate others, use offensive or inappropriate usernames, or share your account with others. You are responsible for all activity that occurs under your account.

14. Payments and Subscriptions

Certain features of Offquest may be offered as paid subscriptions or in-app purchases. All payments are processed through third-party platforms (e.g., Apple App Store, Google Play Store) and are subject to their respective terms and conditions. All purchases are non-refundable except as required by applicable law or the policies of the applicable app store.

15. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio, software, and the overall design and look and feel of the application, are owned by Offquest and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

16. User-Generated Content

By submitting any content through the Service (including reflections, photos, and profile information), you grant Offquest a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content in connection with operating and improving the Service. You retain ownership of your content but are responsible for ensuring it does not violate any laws or third-party rights.

17. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. OFFQUEST EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any Content provided through the Service.

18. Arbitration and Dispute Resolution

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") shall be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except that each party retains the right to bring an individual action in small claims court.

CLASS ACTION WAIVER: YOU AND OFFQUEST AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

If any part of this arbitration provision is found unenforceable, the remainder shall continue to apply. If the class action waiver is found unenforceable, the entire arbitration provision shall be void.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.

20. Termination

Offquest may suspend or terminate your access to the Service at any time, for any reason or no reason, with or without notice, including for violation of these Terms. You may stop using the Service at any time. Upon termination, all provisions of these Terms that by their nature should survive will survive, including Sections 4, 5, 6, 11, 12, 17, and 18.

21. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

22. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Offquest regarding your use of the Service and supersede all prior agreements, understandings, and negotiations.

23. Changes to Terms

Offquest reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the app and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.
